Doctors refuse to terminate foetus with lethal anomaly without nod from husband, who in turn, wants 24-yr-old to withdraw dowry case

A 24-year-old woman, who was allegedly kicked in the abdomen by her in-laws when she was in her second month of pregnancy, has been denied the right to abort her deformed foetus. Aarti Patel (name changed), has been begging her husband to allow her to terminate the foetus since November when her in-laws allegedly battered her over dowry. But he told her he would give her consent only if she withdraws the FIR filed against him and his family members.
Aarti’s ordeal began soon after her marriage on November 29, 2009
Interestingly, the law does not require the spouse’s consent for abortion particularly when the foetus suffers from physical abnormalities. Yet, doctors at V S Hospital where she is receiving treatment, refuse to carry out the termination without her husband’s signature.
The delay of three months means that Aarti, who could have opted for manual vacuum aspiration or suction curettage to remove the foetus easily, will now be forced to deliver the abnormal baby. This because her pregnancy has exceeded 20 weeks and therefore abortion cannot be carried out as per law.
“She is in a terrible condition. The doctors are ignorant about the Medical Termination of Pregnancy Act and have been pressing for the husband’s signature for abortion even when it is not needed. They wasted three months during which the abortion could have been carried out. Now, she has no choice but to deliver the baby, which would possibly be in the eighth month,” said her lawyer Rajendra Shukla.
Aarti Patel (name changed), was allegedly battered by her in-laws over dowry and sent to her maternal home in November. She was then admitted to V S Hospital for treatment. It was during the treatment that her foetus was found to be damaged. As per hospital records, the foetus was detected with multicystic kidney disease in the ultrasound.
“Even private doctors have refused to carry out abortion. This is the height of cruelty. My client is going through hell. Her inlaws had forced her to undergo abortion earlier and now she will be forced to deliver an abnormal baby,” the lawyer said.
The FIR filed by Aarti states that her mother-in-law asked her to get Rs 1 lakh in dowry if she wanted to keep the baby. They allegedly told her they will terminate her pregnancy if she did not undergo abortion. Since she refused to abort the baby, she was allegedly beaten and kicked repeatedly on the abdomen. In a statement to the Vastrapur police, her mother has alleged that Aarti was made to do all the household work and forced to starve.
